Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of erafav.com (the “Site”) and your purchase of products from ERAFAV (“ERAFAV,” “we,” “us,” or “our”), a US women’s fashion and accessories online boutique located at 1023 Newhall St, San Jose, CA 95126, United States. Please read these Terms carefully before using the Site or placing an order.

1. Acceptance of These Terms

By browsing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by our related policies, including our Shipping Policy, Return & Refund Policy, and Privacy Policy. If you do not agree with any part of these Terms, please do not use the Site or purchase from us.

2. Eligibility

You may use the Site and place orders only if you:

  • Are at least 18 years old, or use the Site under the supervision of a parent or legal guardian who agrees to these Terms;
  • Have the legal capacity to enter into a binding contract; and
  • Provide a valid US shipping address, since we currently ship within the United States only.

3. Accounts and Your Responsibilities

You may check out as a guest or create an account. If you create an account, you agree to:

  • Provide accurate, current, and complete information, including your name, email address, and shipping address;
  • Keep your login credentials confidential and not share your account with others;
  • Notify us promptly at care@erafav.com if you suspect unauthorized use of your account; and
  • Accept responsibility for activity that occurs under your account until you notify us of a problem.

We may suspend or close accounts used for fraudulent activity, abuse of our staff, or violations of these Terms.

4. Orders, Pricing, and Order Cancellation

All prices on the Site are listed in US dollars (USD) and do not include applicable sales tax, which is calculated at checkout where required. Placing an order is an offer to purchase; your order is accepted when we send you an order confirmation email.

We work to keep prices and availability accurate, but errors can occur. We reserve the right to:

  • Cancel any order affected by a pricing, description, or inventory error before it ships;
  • Limit quantities per order or per customer; and
  • Refuse orders that we reasonably believe are fraudulent or placed by resellers.

If we cancel your order for any of these reasons, we will notify you at the email address on the order and issue a full refund to your original payment method. If you need to change or cancel an order you just placed, email support@erafav.com within 12 hours of placing the order and before it ships. After that window the order may already be in processing and we may not be able to change it.

5. Payment

We accept the following payment methods:

  • PayPal
  • Visa credit and debit cards

All transactions are processed in USD. By submitting payment, you represent that you are authorized to use the chosen payment method. If your payment cannot be processed or is declined, we will not ship the order and will contact you at the email address you provided.

6. Shipping

We ship to addresses within the United States only. Orders are processed within 1-2 business days, and standard shipping takes 4-8 business days in transit. Standard shipping costs a flat $6.95, and it is free on orders of $75 or more. Orders are fulfilled from partner fulfillment centers located within the United States, and we email you a tracking number when your order ships. 7. Returns and Refunds

You may return most items within 30 days of the delivery date, provided they are unworn or unused with original tags and packaging. Key points:

  • Start a return by emailing care@erafav.com with your order number;
  • You pay return shipping, except for defective, damaged, or incorrect items, in which case we provide a prepaid return label;
  • We charge no restocking fees; and
  • Refunds are issued to your original payment method within 5-10 business days after we receive and inspect the return.

8. Product Information

We work to describe and photograph our products accurately. However, we cannot guarantee that your screen’s display of colors is exact — colors may vary depending on your monitor or device settings. Measurements in size charts are approximate and measured flat; small variations can occur between individual garments. If an item you receive differs materially from its description, it qualifies as an incorrect item under our Return & Refund Policy and we will cover the return shipping.

9. Intellectual Property

All content on the Site — including the ERAFAV name and logo, product photography, text, graphics, and page layouts — is owned by or licensed to ERAFAV and is protected by US copyright and trademark laws. You may not copy, reproduce, republish, or use this content for commercial purposes without our prior written permission. You may share links to our pages and products for personal, non-commercial purposes.

10. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable law or regulation;
  • Submit false or misleading information, including fraudulent orders or chargebacks;
  • Interfere with the Site’s security features or attempt to gain unauthorized access to our systems; or
  • Scrape, harvest, or collect data from the Site by automated means without our written consent.

11. Disclaimer of Warranties

The Site and its content are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of uninterrupted or error-free operation of the Site. This section does not limit your rights under our Return & Refund Policy or any warranty rights that cannot be disclaimed under applicable law.

12. Limitation of Liability

To the fullest extent permitted by law, ERAFAV will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some states do not allow certain limitations of liability, so parts of this section may not apply to you; nothing in these Terms limits rights you have under applicable consumer protection law.

13. Governing Law

These Terms and any dispute arising out of them or your use of the Site are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Santa Clara County, California, unless applicable law gives you the right to a different venue.

14. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our policies, payment methods, or legal requirements. When we do, we will post the revised Terms on this page and update the effective date at the top. Changes apply to orders placed after the revised Terms take effect; the Terms in effect when you placed your order govern that order. We encourage you to review this page periodically.
